Nanjing Vocational Institute of Transport Technology Implementation Rules of Disciplinary Punishment for International Students

 Chapter 1  General Provisions

Article 1 In order to implement the national education policy, promote the healthy development of the education of international students in our school, and create an excellent learning and living environment for students, these detailed rules are formulated in accordance with the Law of the People's Republic of China and combined with the actual situation of international students in our school.

Article 2 These Detailed Rules shall apply to international students studying at the school.

Article 3 During the period of study, international students who violate discipline in or outside the school shall be given disciplinary sanctions in accordance with these Detailed Rules.

Article 4 The school shall carry out disciplinary punishment for international students who have violated discipline in accordance with the due procedures, sufficient evidence, clear basis, accurate characterization, and the appropriate punishment.

Article 5 International students who violate school rules and discipline shall be given the following sanctions according to the seriousness of the circumstances, the attitude of admitting mistakes, the performance of repentance, etc.:

(1) Warnings;

(2) Serious warnings;

(3) Record a demerit;

(4) Probation in schools;

(5) Expulsion from school.

Article 6 If two or more persons jointly violate discipline, they shall be dealt with separately on the basis of their respective circumstances.

Article 7 Where an international student violates school rules and discipline, but the circumstances are minor enough to give the above sanctions, they shall be notified and criticized and urged to correct their mistakes.

Article 8 The person who has been punished shall at the same time cancel his or her qualifications for all good appraisals and awards in the current academic year and partially or completely cancel his or her scholarship qualifications according to the actual situation during the annual appraisal.

Article 9 A student who violates school discipline may be given a mitigated or exempt punishment in any of the following circumstances:

(1) Being able to take the initiative to admit mistakes, truthfully confess erroneous facts, examine and understand profoundly, and show repentance;

(2) It is truly coerced or deceived by others;

(3) Being able to proactively report or expose others' violations of discipline, and actively assisting relevant departments in investigating and handling problems;

(4) There are other circumstances that may be given a lenient punishment.

Article 10 Those who violate school discipline shall be given a heavier punishment if they have any of the following circumstances:

(1) Refusing to admit mistakes or shielding others' violations of discipline after violating discipline;

(2) Retracting confessions, colluding in confessions, or retaliating against relevant personnel or threatening intimidation during an investigation;

(3) There are two or more violations of discipline at the same time;

(4) Colluding with personnel outside the school to commit crimes;

(5) Organizers or commanders of groups that violate discipline;

(6) After receiving a punishment, the person is punished again;

(7) There are other circumstances that should be given a heavier punishment.

Article 11 Whoever has received a demerit or probationary punishment or has received two serious warning sanctions, and who has again received a demerit or above punishment, causing serious consequences and having a very bad impact, shall be directly given the punishment of expulsion from school.

Article 12 Probation is generally limited to one year. The probation period for international students in the graduation year is half a year. International students who have been placed on probation may be released on time if they have a deep understanding of the mistakes and perform well during the probationary period; those who have outstanding performance may be released from the punishment in advance.

Article 13 A person who has been expelled from school shall leave the school within the time limit prescribed by the school (within 10 days after the disciplinary decision is issued). For those who do not do it within the time limit, the school will notify the exit-entry administration department that the international student will be deported within a certain period of time. The school will cancel the student visa and does not register again if the punishment is expulsion from school.

Article 14 The students who violate discipline shall compensate for the losses or bear the expenses such as medical expenses caused by the students who violate discipline.

 

Chapter 2  Sub-Provisions

Article 15 If there are behavious that violates Chinese laws and regulations, undermines stability, disrupts social or school order, or so forth, depending on the seriousness of the circumstances, the following sanctions are to be given:

(1) Whoever deliberately spreads rumors, fabricates or distorts facts, incites trouble, or pastes illegal propaganda materials to disrupt school or social order, is to be given a serious warning or above.

(2) Whoever, in violation of relevant provisions, participates in illegal assemblies, processions, demonstrations, etc., and does not heed dissuasion, is to be given a serious warning or above; those who organize illegal assemblies, processions, demonstrations, etc., are to be given a demerit or above punishment.

(3) If illegal organizations are established to organize, participate in, or disseminate cults, feudal superstitious activities, and so forth, a serious warning or above is to be given; if the circumstances are serious or the main organizer is to be placed on probation or expelled from school.

(4) Violating the school's regulations on the management of student groups and operating in the name of student groups without registration; or still carrying out activities in the name of the original student groups after having been revoked, explicitly disbanded, or banned, shall be given a serious warning or above.

(5) Where there are other acts that disrupt school or social order or undermine social or school stability not listed in these Articles, corresponding sanctions are to be given in accordance with the relevant provisions.

Article 16 Where violations of Chinese laws or regulations or violations of public security administration regulations are punished by public security, judicial, or other such departments (including warnings, fines, detention, sentencing, etc.), in addition to cooperating with relevant departments in implementing punishments, the school shall give the following sanctions according to the severity of the punishment:

(1) Where a person is given a warning, a fine, or a detention, a punishment of demerit or above is to be given.

(2) Where criminal responsibility is pursued, the punishment of expulsion from school is to be given.

Article 17 Violations of school rules and relevant laws and regulations on the management of foreigners shall be punished with the following sanctions:

(1) Those whose visa or residence permit has expired shall be given a warning or above, depending on the seriousness of the circumstances.

(2) Violating the regulations on the visas of foreign students, illegally working shall be given probation and above sanctions.

Article 18 Whoever plans or participates in a fight inside or outside the school, provides perjury evidence, provides equipment for a fight, etc., shall be given the following sanctions, depending on the seriousness of the circumstances:

(1) No harm was caused to the hands-on beating (the degree of injury shall be appraised by the hospital and relevant departments, the same below.) shall be given a warning or a serious warning; for those who beat someone with their hands and cause serious injuries to others, they shall be given probation or above.

(2) Those who beat people with weapons or those who hit people first in the course of fighting shall be given punishments of demerit or above; those who use knives, daggers, iron tools, etc. to injure people will be given severe punishments.

(3) Where in the name of persuasion favors one party or promotes the development of the beating, a warning or a serious warning is given; where serious consequences are caused, a serious warning or above is given.

(4) Giving serious warnings or demerit punishments to those who plan fights with others and cause consequences; those who cause injury to personnel or damage public or private objects are given a demerit or probationary punishment; where serious consequences are caused, they are to be expelled from school.

(5) Whoever enters another person's dormitory or classroom to stir up trouble, beats another person, or forces another person to leave the dormitory or classroom and carries out a beating, shall be given probation or above.

(6) When the school authorities conduct an investigation into a fight or other disciplinary incident, and witnesses the development of the incident (or knows) and still deliberately gives perjury for others, causing difficulties in the investigation work, give a serious warning or demerit punishment; There is also a heavier punishment for participating in the fight.

(7) Where there is intent to provide equipment for others to fight and brawl, but no consequences are caused, a serious warning punishment is given; where consequences are caused, a punishment of demerit or above is given; where a knife, iron weapon, or other murder weapon is provided, a heavier punishment is given.

(8) Organizers of fights and brawls and retaliators after the fact shall be given heavier punishments in accordance with the corresponding provisions.

(9) Those who beat up faculty members shall be given heavier punishments in accordance with the corresponding provisions of this Article.

(10) Where there are other acts of fighting and brawl not listed in these Provisions, corresponding sanctions shall be given in accordance with the relevant provisions.

Article 19 Whoever commits any of the following acts of infringing upon State, collective or private property shall be punished separately, depending on the circumstances and the amount of property or money, in addition to recovering stolen money or stolen property or compensating for losses:

(1) Theft or crime (including joint crime, the same below.) Where the amount is relatively small and does not constitute a crime, a warning, a serious warning, or a demerit punishment is given; where the amount is relatively large and constitutes a crime, it is given the punishment of probation or expulsion from school.

(2) Whoever steals or commits a crime many times shall be given a punishment of probation or above in school according to the accumulated value of the property or money he stole; after being punished for stealing or committing a crime, he shall be given the punishment of expulsion from school.

(3) Those who enter a house to steal or commit a crime shall be given a punishment of probation or above; those who intentionally provide various information and conditions for committing a crime for the theft or perpetrator shall be punished as a joint perpetrator and given corresponding punishment; and those who organize the theft or crime shall be given a heavier punishment.

(4) Whoever fraudulently takes a deposit, remittance (slip) or mail from another person shall be given a punishment of demerit or above; where a valuable certificate, magnetic card, mobile phone, etc. of another person is picked up and appropriated for his own use and used for consumption, a serious warning or above shall be given.

(5) Whoever steals official seals, valid certificates, confidential documents, archives, or other such items shall be given a punishment of demerit or above.

(6) Where public or private property is fraudulently obtained through various means, or extorts public or private property, sanctions are to be given with reference to the corresponding provisions above; where minors' property is fraudulently obtained or extorted, the punishment is heavier.

(7) Whoever robs or uses violence to rob public or private property shall be given a punishment of demerit or above.

(8) Where public or private property is intentionally damaged, where the circumstances are relatively minor, a warning or a serious warning is given; where the circumstances are more serious, a serious warning or above is given; where public or private property is intentionally damaged repeatedly, probation or above is given.

Article 20 Whoever purchases, conceals or sells stolen goods shall be given the following sanctions, depending on the seriousness of the circumstances:

(1) Where the purchase of stolen goods (where it is known to be stolen goods), where the circumstances are less serious, a warning or a serious warning is given; where the circumstances are more serious, a punishment of demerit or above is given.

(2) Where stolen goods are concealed or sold for others, punishments of demerit or above are to be given.

Article 21 Whoever smuggles, sells smuggling, illegally engages in business, resells or pyramid schemes shall be given the following sanctions, depending on the seriousness of the circumstances:

(1) Where smuggling or smuggling is smuggled, depending on the nature of the smuggled or smuggled goods and the circumstances of the violation of discipline, a serious warning or above shall be given.

(2) Those who illegally engage in business or illegally resell without the approval of the administrative department for industry and commerce or the relevant department of the school shall be given a serious warning or a punishment of demerit; those who repeatedly engage and do not change, shall be given probation and above punishment.

(3) If illegal pyramid schemes are organized or participated, a serious warning or above is to be given.

Article 22 The School prohibits international students from gambling, and those who participate in gambling or covert gambling shall be given a demerit or above punishment depending on the seriousness of the circumstances.

Article 23 Whoever commits the following uncivilized conduct that obstructs the management order of society or schools, damages the image of school students and social morality, or so forth, shall be given the following sanctions, depending on the seriousness of the circumstances:

(1) Those who participate in prostitution or other pornographic services shall be directly expelled from school.

(2) Those who exceed the scope or boundaries of normal interaction between men and women, and who have had too close contacts and cause serious consequences, shall be directly expelled from school.

(3) Where there is hooliganism such as nuisance or indecency, a punishment of demerit or above is to be given depending on the circumstances.

(4) Where alcoholism is drunk inside or outside the school, the first offender is given a warning punishment, the second time offender is given a serious warning punishment, and the repeat offender is given a demerit or above sanction; for those who are drunk, picking quarrels and provoking trouble, fighting and disrupting the order inside and outside the school, the punishment of demerit or above is given.

(5) Where binoculars, cameras, mobile phones, or other means are used to peep or secretly photograph the privacy of others, a serious warning is to be given; where the circumstances are serious and the impact is bad, a demerit or above sanction is given.

(6) Where audio equipment is used in a public place, the volume is too loud, affecting the normal work or rest of others, and dissuasion is not heeded, a warning or a serious warning is given; if repeated and not changed, a demerit or above punishment is given.

(7) Where student ID cards, library cards, graduation certificates, and so forth are deliberately altered or forged; where student ID cards and other documents are lent to others causing negative consequences, a serious warning or above is to be given.

(8) Whoever litters, smokes, makes noise, or has other obstacles to the normal teaching and living order of the school and does not change it through education, shall be given a warning or above.

(9) Trampling on and destroying lawns, picking and breaking flower branches, or scribbling on public property such as school buildings or desks, shall be given a warning or above.

(10) Where on campus, violations of school management regulations, disrupt the normal education and teaching order of the school, the order of life, the order of management of public places, or violations of the code of conduct for college students, are to be given a warning or above.

Article 24 Whoever watches, disseminates, reproduces, or sells illegal books, periodicals, audio-visual products, or obscene materials shall be given a severe warning or above, depending on the seriousness of the circumstances;

Article 25 Whoever violates the regulations on the management of student apartments and affects the normal order of life shall be given the following sanctions depending on the seriousness of the circumstances:

(1) Failure to comply with the regulations on the management of student apartments, influencing the rest of others in various ways in the apartment or dormitory, and still not correcting or repeating the offense after criticism and education, shall be given a warning or a serious warning punishment; if he climbs in and jumps out of the dormitory window, he shall be given a warning or a serious warning punishment; if he does not return at night without asking for leave, he shall be given a serious warning or above; and for those who live in an off-campus rent without permission and do not return at night, they shall be given probation and above.

(2) Unauthorized transfer of dormitories or beds, occupation of students' dormitories, refusal to implement the uniform dormitory adjustment of the school, and failure to change after criticism of education, shall be given a serious warning or demerit punishment; where beds are privately occupied, lent, or rented, a demerit or above sanction shall be given.

(3) Where electricity or fire is used in violation of regulations in apartments or dormitories, a warning or a serious warning is given; where negative consequences are caused, a punishment of demerit or above is given.

(4) Whoever smokes, retains or uses prohibited items (alcohol stoves, kerosene stoves, electric heaters, etc.) in student apartments or dormitories shall be given a warning or a serious warning sanction; where consequences are caused, in addition to compensating for losses, a demerit punishment shall be given; where major losses are caused, probation or above shall be given; and those who repeat offenders shall be given a demerit or above sanction.

(5) Where an outsider stays overnight without approval, or arranges for an outsider to live in another person's dormitory, he or she shall be given probation or above.

(6) Where the opposite sex stays overnight in the dormitory of the opposite sex or accommodates the opposite sex in the dormitory, it is given the punishment of probation or expulsion from the school; if the personnel in the same dormitory do not report it, they are given a serious warning punishment.

(7) Whoever, in violation of the relevant provisions of the apartment, throws or dumps debris in the apartment or dormitory, keeps pets, deliberately wastes water and electricity, and other such behaviors are still not corrected after education, a warning or above is given.

(8) Where there are other violations of the relevant provisions on the management of student apartments not listed in these Articles, corresponding sanctions shall be given in accordance with the relevant provisions.

Article 26 Where in the course of education, teaching, and examinations, there are the following violations of study and examination regulations, the following sanctions are to be given, depending on the seriousness of the circumstances:

(1) Whoever, without asking for leave, does not participate in schools, grade meetings, collective activities, etc., shall be punished as absenteeism.

(2) During the period of teaching experiments, probations, or internships, those who violate the operating procedures and do not obey the guidance and dissuasion of teachers shall be given a warning sanction; where accidents and consequences are caused, a serious warning or above shall be given.

(3) Where school management personnel are obstructed from performing their official duties in accordance with laws and regulations, a warning or a serious warning is given; If managers are verbally abused or use violence in the performance of their official duties, a demerit or above sanction is given; where the order of classroom teaching or examinations is disrupted, a warning or a serious warning is given; where teachers and staff are insulted or beaten, causing an impact on the order of classroom teaching or examinations, a demerit or above sanction is given.

(4) The measures for handling absenteeism of international students shall be handled in accordance with the following regulations. Those who miss 10 hours of classes without reason or 3 consecutive days of absenteeism in each semester shall be given a serious warning sanction; those who miss 30 hours of absenteeism or two consecutive weeks of absenteeism shall be expelled from school.

(5) In the course of examinations, any of the following acts are deemed to be violations of discipline in the examination, and a warning or serious warning is given.

1. Violating regulations by not placing school bags, books, notes, etc. in the designated place and not listening to dissuasion;

2. Failure to take the exam according to the prescribed seats;

3. Before the test start instruction is issued and after the test end instruction is issued, the questions are answered in advance or continued;

4. Peeking at other people's examination papers, exchanging words with others during the examination;

5. Deliberately bring test papers, answer cards, etc. out of the examination room;

(6) In the examination, if one of the following acts is committed, it is regarded as cheating on the examination and is given the punishment of demerit or above.

1. Illegally bringing materials related to the content of the test or electronic devices with materials related to the content of the test to participate in the test;

2. Plagiarism, organization or assistance to others in plagiarism;

3. Snatching or stealing other people's examination papers or answer sheets, or forcing others to provide convenience for their own plagiarism;

4. Exchanging examination papers, passing note answers, checking answers or the same examination papers during the examination;

5. Fill in the name, student number and examination number on the examination paper that are inconsistent with my identity;

6. Deliberately destroying examination papers or examination materials;

7. Threatening, insulting, slandering or framing the examination staff or other candidates.

(7) Where relevant examination questions are obtained by improper means and do not cause greater impact and consequences, they shall be given the punishment of demerit or probation; where a greater impact or serious consequences are caused, they shall be given the punishment of expulsion from school.

(8) Whoever tampers with the examination results without authorization shall be given the punishment of having a demerit record or above.

(9) Where others take the exam instead of or for others, use communication equipment during the exam process, collectively organize cheating (three or more people cheat jointly), plagiarize or copy the research results of others, resell or illegally transfer school scientific and technological achievements, where the conduct and circumstances are serious, give punishments of demerit or above.

(10) Where there are other violations of education, teaching and examinations not listed in these Provisions, corresponding sanctions shall be given in accordance with the relevant provisions.

Article 27 Whoever violates the regulations on the management of school fire control, electricity use, fire use, etc., and destroys school electrical equipment, fire fighting and other public facilities, shall be given a punishment of demerit or above, depending on the seriousness of the circumstances;

Article 28 Where there are the following conducts infringing upon the personal rights of others, the following sanctions are to be given, depending on the seriousness of the circumstances:

(1) Where letters or mail of others are concealed, destroyed, or privately opened, a warning or a serious warning is given; where the circumstances are serious, a demerit record or above is given.

(2) Insulting others or fabricating facts to slander others, using threatening letters, harassing phone calls, or other means to threaten the safety of others or interfering with the normal study or life of others, give a serious warning or above punishment.

Article 29 Where there are the following acts of endangering public security, depending on the seriousness of the circumstances, the following sanctions are to be given:

(1) Those who carry or store controlled knives in the school shall be given a warning or a serious warning punishment.

(2) Where in large-scale activities, they do not listen to commands, causing chaos, crowding, or other behaviors that affect safety, and still do not correct them after being discouraged by education, they are to be given a warning or a serious warning punishment; those who deliberately create chaos or provoke an incident are given a punishment of demerit or above.

Article 30 Whoever, in violation of relevant provisions on computer Internet management, consults, produces, reproduces, or disseminates illegal or harmful information, engages in activities that endanger the network security of computer information, illegally obtains or misappropriates information from other units or individual network users, and so forth, depending on the seriousness of the circumstances, is to be given a serious warning or above.

Article 31 During special periods of public health incidents, natural disasters, accidents, disasters, and other emergencies, if school emergency management regulations are not strictly observed, school work is not actively cooperated, or school management is disobeyed, it is to be dealt with severely.

Article 32 Where there are other violations of discipline not enumerated, corresponding disciplinary sanctions may be given with reference to similar provisions in these Detailed Rules.

 

Chapter 3  Authority and Procedures for Sanctions

Article 33 Approval authority and approval procedures for sanctions for students who violate discipline:

(1) Warnings, serious warnings, and demerit sanctions shall be handled by the counselors of international students, reviewed by the Office of International Cooperation and Exchange, and a written decision on punishment shall be issued and filed for the record.

(2) The punishment of probation or expulsion from the school shall be handled by the International Cooperation and Exchange Office, and after the competent school leaders agree, they shall be reported to the dean's office meeting for study and decision.

(3) The Office of International Cooperation and Exchange shall jointly handle incidents involving the whole school or the punishment of students from two or more faculties in conjunction with the relevant faculties. Under special circumstances, the Office of International Cooperation and Exchange may directly punish international students who violate discipline.

Article 34 Disciplinary Punishment Procedures for International Students:

(1) Before giving a disciplinary sanction to an international student who violates discipline, he or she shall hear the statements and defenses of the international student himself or his/her agent. Representations are expressed in writing and shall enter into force upon signature.

(2) When giving disciplinary sanctions to international students who violate discipline, the counselors of international students should fill in the Registration Form for Disciplinary Sanctions of Foreign Students of Nanjing Communications Vocational and Technical College (in duplicate), and the counselors of international students should hand over the Registration Form for Disciplinary Sanctions of Foreign Students of Nanjing Communications Vocational and Technical College to the sanctioned international students themselves, and the students who were punished should sign the Registration Form for Disciplinary Sanctions of Foreign Students of Nanjing Communications Vocational and Technical College.

(3) The international student counselor shall report the facts of the student's violation of discipline, circumstantial evidence, written statement and defense materials of the student who violated discipline or his agent, and other relevant evidence to the International Cooperation and Exchange Office for the record.

Article 35 If an international student does not submit an appeal within the 5-day appeal period from the date of delivery of the punishment decision, the school will no longer accept the appeal submitted by the student.

 

Chapter 4  Supplementary articles 

Article 36 The Office of International Cooperation and Exchange shall be responsible for the interpretation of these Detailed Rules.

Article 37 These Detailed Rules shall come into force on May 1, 2020. Where other relevant regulations are inconsistent with these Regulations, these Regulations shall prevail.
